Albuquerque Enforces Removal of Kratom Products Amid Compliance Action

ALBUQUERQUE, N.M. — The City of Albuquerque’s Environmental Health Department (EHD) has embargoed and removed over 5,400 kratom-containing items from more than 50 retailers, citing regulatory non-compliance and invoking federal guidance on kratom’s status. According to a municipal press release, the effort began with outreach in July–August 2025 and escalated into full enforcement after Labor Day, with fines of $250 escalating up to $1,000 per infraction.
The city also referenced links between kratom and adverse events such as liver toxicity, seizures, and substance use disorders. Officials emphasized that the removal is a health measure and not a broad prohibition against botanical sales in general. Retailers with permit licenses were given time to comply or appeal.
This municipal action takes place against a backdrop of increasing regulatory attention to kratom across the U.S., as jurisdictions struggle to balance consumer protection, botanical access, and scientific uncertainty.

Albuquerque’s enforcement hinges on compliance with existing city ordinances and federal guidance. Over July and August, EHD conducted education outreach to retailers to help them identify kratom products and understand removal requirements. After September 1, inspections uncovered non-compliant stores, which were served citations and required to surrender kratom products.
The city frames the move as a consumer protection measure—particularly oriented toward preventing unregulated access by youth and minimizing exposure to potentially harmful substances. As Mayor Tim Keller remarked, “The removal of kratom from the shelves of retailers in our city is another step” in protecting residents’ health.
Local media have picked up the story, noting that Albuquerque is aligning its actions with federal safety advisories and may influence other municipalities’ policies on kratom retail oversight.
While Albuquerque’s action is local, it reflects broader tensions in how kratom is treated legally, especially when synthetic or concentrated derivatives are involved.
